Terms of Service

DSCVR is a Solana-wallet beer discovery and collaboration platform. We list partner breweries and beers, let you earn points, hold off-chain beer credits, pay at venue POS, and (as we ship them) play gacha / vending games and buy merch, brew kits, and recipes.

Commercial deals with a specific brewery or bar — including per-pour fees described on How It Works — live in a separate partnership agreement. If that agreement conflicts with these Terms on a commercial point, the partnership agreement controls for that partner. These Terms still govern use of the website and tools.

We may update these Terms. Continued use after we post a new “Last updated” date is acceptance. Material changes will be noted on this page.

The Service is for adults of legal drinking age in the place you use it — 21 or older in the United States. You represent that you meet that standard each time you enter.

We use an age gate and may store your acknowledgement (locally and, if a wallet is connected, on your user profile). That is a representation by you, not government ID verification. We may ask for more proof later (shop alcohol-adjacent goods, prize shipping, venue POS).

You must be able to form a contract. You may not use the Service if you are on a sanctions list, in a prohibited jurisdiction, or if local law bars you from crypto wallets, chance-based promotions, or alcohol marketing.

We do not knowingly collect data from or market alcohol to anyone under legal drinking age. If we learn we have, we will delete that profile access.

You access most features by connecting a Solana-compatible wallet. Your public key is your account. We do not hold your seed phrase or signing keys. You are responsible for the wallet, device, and any person who uses it.

On-chain actions (USDC payments, buybacks, future mint/claim transactions) are public on Solana. We cannot reverse a confirmed transaction. Network fees are yours.

Admin roles (God, Sub-admin, Ambassador) are privileges we grant and can revoke. They do not transfer with a compromised wallet unless we say so.

Today or as released, the Service may include:

• Public catalog, globe, search, favorites, ratings, and badges
• Check-ins near a listed venue and outbound link tracking
• Points, beer credits, gifts/claim links, USDC purchase, and USDC buyback
• Venue POS QR tabs that burn credits and collect USDC
• Self-serve brewery requests and partner admin tools
• Gacha / vending games with randomized digital and/or physical rewards
• Shop for merch, brew kits, recipes, and other goods we list

Features can be paused, geo-blocked, or changed. Pre-launch listings may be blurred until we or the partner approve them.

Points are a promotional ledger we run off-chain. They are not money, crypto, or a stored-value product. We set earn rates and daily caps (for example, check-in points and outbound-link points in a UTC day) and may change them.

Points can expire, be clawed back for abuse, or fail to award if you hit a cap. They have no cash value except as we allow conversion into beer credits under then-current rates.

Beer credits (Domestic, Craft, Premium Craft) are off-chain platform balances. Displayed USDC amounts (currently $5 / $10 / $15) are internal prices for buying, applying at POS, or quoting buyback — not a bank deposit and not a claim on a specific keg.

You may earn credits by redeeming points, buy them with USDC, receive them from another user, or claim a gift link. You may send them, create a claim link, burn them at a DSCVR POS tab, or request a buyback where offered (currently 85% of the displayed USDC price after a 15% fee).

Credits are not securities, e-money, or a right to any particular beer SKU. A partner may refuse service. We may freeze, reverse, or expire credits for fraud, error, chargeback-equivalent abuse, or legal risk. Buyback can be paused or ended.

Gift links debit the sender when created. If you cancel a pending link, credits return to you. If someone else claims it, that is final.

Purchases and POS remainders send USDC on Solana mainnet to our treasury. Buybacks pay USDC from treasury after we debit credits. Memos on-chain may include your wallet and cart.

Blockchain records are public and permanent. Forks, congestion, failed RPCs, wallet bugs, and phishing are your risk. We are not a broker, exchange, bank, or money transmitter beyond operating our own treasury for Service payments.

If an on-chain payment confirms but our credit mint or POS settle fails, contact us with the transaction signature. We will reasonably attempt to complete the intended credit or tab. We do not guarantee a timeline.

DSCVR POS lets authorized staff (God and Sub-admin only) open a short-lived tab and QR. You scan, apply matching credits first, and pay any remainder in USDC. Completing a tab burns those credits.

Tabs expire if unused. A tab locked to another wallet cannot be paid twice. Staff may cancel an unpaid tab. POS is a DSCVR checkout tool — it is not the partner’s own merchant account, and it does not by itself create a sale of alcohol by DSCVR. The venue sells the pour under its licenses. You must follow house rules and local alcohol law at the venue.

We may offer pack-opening, vending, or other chance-based games (“Gacha”) modeled on collector-style machines: you spend credits, USDC, or other accepted value for a randomized outcome from a published prize pool (digital items, more credits, merch, kits, experiences, or partner pours).

• Odds, prize pools, and prices will be shown at the point of play. We may change pools going forward; we will not secretly alter an already-committed pull.
• Outcomes are random (or verifiably random if we say so). You may receive a low-value result. No expected-value, investment, or resale promise.
• Opened packs and completed pulls are final. We do not refund spent credits or USDC because you dislike the result.
• Gacha is entertainment. It is void where chance-based promotions, lotteries, or gambling laws forbid it. We may geo-block or require extra checks.
• Physical prizes ship only if you can legally receive them (age, address, alcohol rules). We may substitute a credit refund or alternate prize if we cannot fulfill.
• Prize items are not investment contracts. Secondary trading, if any, is unaffiliated unless we run an official market.

Do not play Gacha if you cannot afford to lose the credits or USDC you put in. We may set spend limits or suspend accounts for abuse or problem-gambling risk.

The shop (when live) may sell apparel, glassware, brew kits, recipe cards or digital recipes, ticketed experiences, and similar goods. Listings show price, currency (often USDC or another method we add), and any shipping estimate.

Recipes and kits are for lawful homebrewing or education. You are responsible for local homebrew, tax, and sanitation rules. A kit is not a promise of commercial beer quality. Unless a listing says it contains alcohol, it does not.

We do not ship alcoholic beverages into any place that forbids it, to anyone under legal drinking age, or without required licenses. If a listing cannot legally ship to you, the sale is void and we refund the purchase price we actually received (less non-refundable chain fees if already spent).

Title and risk of loss pass when the carrier takes the parcel, unless law says otherwise. Inspect on arrival and contact us promptly for damage.

Returns: unused merch in original condition within 14 days of delivery may be returned for store credit or refund of the item price (you pay return shipping unless we shipped the wrong item). Opened kits, perishable goods, worn apparel, digital recipes, and Gacha pulls are not returnable. Partnership volume fees and POS burns are not shop returns.

Independent breweries and bars may request a listing, appear in the catalog, host a collab beer, or appear on the globe. A submitted request is not acceptance. We may blur, reject, unblur, feature, or remove a listing.

You warrant that names, logos, photos, addresses, and beer copy you give us are accurate and that you have the right to grant us a worldwide, royalty-free license to display them on the Service and in co-marketing. You remain responsible for your alcohol licenses, tap quality, allergens, and in-person sales.

How It Works describes a typical model: no listing fee, and a per-unit amount (for example $0.80–$1.00 per 12–16 oz of collab beer sold) verified from POS reports. That is an invitation to deal, not a public offer. Signed paper or a countersigned form controls.

Ambassadors and Sub-admins act for DSCVR under our direction. They are not your employees. Attribution on a create (wallet / role) is for our records and possible future rewards — it is not equity.

Partners must not imply DSCVR sells alcohol at retail unless a specific licensed arrangement says so. Collab beers are brewed and sold by the licensed partner at the source, unless we state otherwise.

Reviews, notes, photos, brewery submissions, and other materials you post (“User Content”) stay yours. You grant us a license to host, display, and moderate them to run the Service.

Review notes may be private to you; star ratings and aggregates may be public. Do not post others’ personal data, illegal content, or anything you do not have rights to. We may remove content and are not obligated to publish every submission.

You will not:

• Lie about age or buy/play for someone who is underage
• Exploit check-in GPS, outbound links, or referrals to farm points
• Attack, scrape beyond reasonable use, or reverse engineer the Service
• Interfere with POS tabs, claim links, or another user’s wallet
• Use the Service for money laundering, sanctions evasion, or unlicensed alcohol sales
• Resell credits as cash-out rails or treat Gacha as a financial product
• Harass partners, staff, or other users

DSCVR names, logos, site design, globe treatment, copy, and software are ours or our licensors’. Partners retain their brewery marks; they license us to show them. You get a limited, revocable right to use the Service for its intended purpose — not to clone the brand, scrape the catalog for a competing product, or mint unofficial “DSCVR” tokens.

Future NFTs or digital collectibles, if any, will have their own license at mint. These Terms do not sell you on-chain IP unless a listing says so. Beer NFTs are not part of the current product.

Wallets, Solana, USDC issuers, RPC providers, Firebase / Google Cloud, carriers, and partner taprooms are third parties. Their outages, fees, and terms are outside our control. Outbound links leave our site. Maps and brewery websites are not our content.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not warrant uninterrupted access, accurate catalog data, available inventory at a venue, a particular Gacha result, or that credits or points will keep a value. Alcohol involves health and legal risk — drink responsibly. Homebrew and recipes are at your own risk.

DSCVR is not a brewery (unless a specific SKU says we are the licensee), not your wallet provider, and not a party to the pour between you and a taproom except as a discovery and credits layer.

TO THE FULLEST EXTENT ALLOWED BY LAW, DSCVR AND ITS OFFICERS, CONTRACTORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, DATA, CREDITS, OR GOODWILL.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS CAPPED AT THE GREATER OF (A) US $100 OR (B) THE AMOUNTS YOU PAID US IN USDC (EXCLUDING THIRD-PARTY NETWORK FEES) IN THE THREE MONTHS BEFORE THE CLAIM. Some places do not allow these limits; there they apply only as far as permitted.

You will defend and indemnify DSCVR and our people against claims, damages, and reasonable legal fees arising from your use of the Service, your User Content, your venue or homebrew conduct, your breach of these Terms, or your violation of law or third-party rights.

We may change, suspend, or end any part of the Service, including POS, buyback, Gacha, or shop SKUs, without liability. We may suspend a wallet for suspected abuse, legal risk, or operational reasons.

You may stop using the Service at any time. Unused points and credits may be forfeited if we shut down a program or your account after a material breach. On-chain history remains on Solana.

These Terms are governed by the laws of the State of Washington, USA, without regard to conflict-of-law rules, except that the Federal Arbitration Act governs arbitration.

Informal resolution first: email partnerships@dscvr.beer and wait 30 days. After that, any dispute will be resolved by binding individual arbitration (AAA Consumer Rules, or a mutually agreed arbitrator). You and we waive class actions and jury trial to the extent allowed. You may opt out of arbitration within 30 days of first accepting these Terms by writing to the same address with your wallet and a clear opt-out.

Small-claims court in King County, Washington or your home county remains available for qualifying claims. If arbitration is unenforceable, courts in Washington State have exclusive jurisdiction.

If a section is invalid, the rest stays in force. These Terms are the entire agreement for the Service unless a signed partnership or shop invoice says otherwise. We are not liable for delay caused by events beyond reasonable control.
